Terms of Service

These Terms of Service ("Terms") govern your use of the HavenVault website at havenvault.net and any services provided by HavenVault, operated by HavenLabs, based in Ogden, Utah ("we," "us," or "HavenVault"). By accessing our website or using our services, you agree to these Terms.

1. Services

HavenVault provides NAS-based private photo storage systems, including hardware selection, in-home installation, configuration, and a one-year protection plan. Services are currently available to customers located in Utah.

All service offerings, pricing, and availability are subject to change. We reserve the right to limit service to specific geographic areas or customer types at our discretion.


2. Waitlist and Consultation Requests

Submitting a waitlist form or consultation request does not constitute a purchase, reservation, or binding agreement of any kind. It expresses your interest in our services and initiates a non-binding conversation.

No payment is required to join the waitlist. Joining the waitlist does not guarantee selection, availability, or a specific installation date. We will contact you if and when we are ready to proceed with your installation.

We reserve the right to decline any request or remove anyone from the waitlist at our discretion.


3. Pricing and Payment

All prices are listed in U.S. dollars. Prices displayed on our website are estimates and are confirmed during your free consultation. We reserve the right to update pricing at any time.

Payment for services is processed securely through Stripe, a third-party payment processor. By completing a payment, you agree to Stripe's Terms of Service. We do not store your payment card information.

Payment is due at the time of reservation, prior to scheduling your installation. A reservation confirms your installation slot and package.


4. Refunds and Cancellations

If you need to cancel a reservation before your installation date, please contact us at hello@havenvault.net as soon as possible.

Refund eligibility is determined on a case-by-case basis and depends on factors including how far in advance the cancellation is made and whether hardware has been ordered or prepared on your behalf. We will make reasonable efforts to accommodate cancellation requests made more than 7 days before your scheduled installation.

If we are unable to fulfill your installation for any reason on our end, you will receive a full refund.


5. Installation and Service Scope

Our standard installation includes hardware setup, RAID configuration, network integration, remote access configuration, and a walkthrough of your new system. Installation is typically completed in a single visit of approximately one hour.

You are responsible for providing a suitable location and network environment for the hardware. We will discuss requirements during your free consultation.

HavenVault installs and configures equipment in good faith based on the information you provide about your environment. We are not responsible for pre-existing network issues, incompatible infrastructure, or factors outside our control that affect system performance after installation.


6. Protection Plan

All packages include a one-year HavenVault Protection Plan. This plan covers:

  • Remote troubleshooting support via email
  • Guidance on drive replacement if a failure occurs during the plan period
  • Reasonable assistance with access issues related to our configuration

The protection plan does not cover physical damage, theft, catastrophic hardware failure beyond normal RAID recovery, or issues caused by modifications you make to the system after installation. Details are provided during your consultation.


7. Your Responsibilities

By using our services, you agree to:

  • Provide accurate information in all forms and communications
  • Not use our website or services for any unlawful purpose
  • Not attempt to disrupt or misuse our systems, forms, or communications
  • Take reasonable steps to maintain your system after installation (such as monitoring drive health through the provided interface)

8. Intellectual Property

All content on the HavenVault website — including text, images, branding, and design — is owned by HavenVault / HavenLabs and may not be reproduced, distributed, or used without written permission.


9. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

While we take data protection seriously, we cannot guarantee that hardware will never fail or that data loss will never occur. We strongly encourage all customers to maintain independent backups of critical files.


10. Limitation of Liability

To the fullest extent permitted by applicable law, HavenVault and HavenLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of business, arising out of or related to your use of our services.

Our total liability for any claim arising from our services shall not exceed the amount you paid us for the specific service giving rise to the claim.


11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the courts of Weber County, Utah.


12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted at havenvault.net/terms with a revised "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
